England has made ten percent biodiversity net gain a condition of planning permission - how does the statutory accounting operate, and which scientific weaknesses has it exposed?

Under the Environment Act, most new development in England since February 2024 must leave biodiversity at least ten percent above the pre-development baseline. A statutory habitat metric scores gains by type, extent and condition of habitat, deliverable on site, through off-site land purchases or government credits, with upkeep locked in for at least thirty years. Critics object that the metric prices habitat shells while ignoring species composition, lets rare irreplaceable habitats be traded away cheaply, and rests on thirty-year pledges far shorter than succession timescales, with monitoring funding unresolved - gains that may live mostly on paper.

Why do some scholars denounce biodiversity offsetting as a Faustian bargain, and what role does time lag play in that criticism?

Because offsetting habitually trades present habitat loss for promises of future restoration, two processes wildly out of step in time. Habitat vanishes the day bulldozers arrive, while newly planted woodland or recreated wetland takes decades to centuries to approach a reference ecosystem; through that window species keep disappearing, piling up a restoration debt that may never be settled. Add the genuine odds that restoration fails outright, and exchange ratios that ignore the delay, and balance exists only on paper. Maron and colleagues therefore insist temporal risk enter offset design, ratios and permit review.

Which steps make up the mitigation hierarchy that governs biodiversity offsetting, and why is its no-net-loss goal widely challenged in practice?

Avoid, minimise, restore, offset - strictly in that order. A project should first be sited away from sensitive habitat, then shrink the scale and intensity of remaining impacts, repair damaged areas in place, and only at the end compensate residual losses by protecting or recreating equivalent habitat, aiming for no net loss - ideally net gain - of biodiversity. The scepticism rests on three points: species composition and ecological function rarely substitute one-for-one, restoration often lags for decades and can fail outright, and baselines and exchange ratios invite optimistic accounting, so researchers insist offsets remain a last resort, not a licence to pay and destroy.

How does a wetland mitigation bank in the United States work, and why do developers buy its ecological credits?

A restore-first, sell-later credit system. A bank sponsor restores or creates a consolidated wetland parcel ahead of any impact; once an interagency review team certifies the site, its functional acreage is converted into sellable credits. Under Section 404 of the Clean Water Act, a developer whose project unavoidably damages wetlands must secure enough credits before a permit issues, usually at ratios above one-to-one. Concentrated, completed-in-advance restoration at watershed scale delivers better ecological coherence and clearer long-term stewardship than piecemeal fixes.
